Terms of service
1. Agreement
a. Your use of the Site is subject to compliance with the terms and conditions set out below. If you do not agree to these Terms of Use, please do not use the Site.
b. J.SPIBY, Business name as PRINT3D PRECISION may update or modify these terms at any time, and such modifications will take effect immediately upon being posted on the Site. Continued use of the Site will be considered conclusive acceptance of the modified terms. However, contracts concluded under earlier terms remain valid, provided you can demonstrate which version applies.
c. All orders placed are accepted subject to these terms and conditions, which override any variations or additional terms in your order or documents. No modification of these terms is binding on PRINT3D PRECISION unless agreed in writing by an authorised representative.
d. By using the services provided by PRINT3D PRECISION, you acknowledge and agree to these terms, which form a legally binding agreement between you and PRINT3D PRECISION. If you do not agree, you must refrain from using our services.
2. Usage of the Service
a. PRINT3D PRECISION offers services for producing your designs. You may use these services only if you are of legal age to enter into a binding contract. If you create an account, it will be secured with a password.
b. You are responsible for maintaining the confidentiality of your account password and for all activity conducted under your account. You must notify PRINT3D PRECISION immediately of any unauthorised use. PRINT3D PRECISION cannot and will not be liable for any loss or damage arising from your failure to protect your account and password.
c. You are solely responsible for:
1) providing accurate, current, and complete information as requested in your account details, and
2) maintaining and promptly updating this information to keep it accurate, current, and complete.
3. Ordering Process
a. The ordering process is as follows: you upload or select the model you want produced by PRINT3D PRECISION; you choose the material, colour, finish, and size (noting that sufficient thickness is required – guidance is provided during ordering); you select the delivery country; you review the order summary including production, delivery, and applicable taxes; you select a payment method, complete payment, and confirm the order. Before finalising payment, you may return to earlier steps using the “back” button to correct errors.
b. You must ensure that all order information is accurate and complete before paying. Once payment is made, modifications are not possible as production begins immediately. Changes are only permitted if expressly agreed in writing by PRINT3D PRECISION.
c. Placing an order constitutes an offer to purchase. Once submitted, you will receive an email confirming your order details. This confirmation creates a binding contract, except where grouped models (two or more designs in one file) are involved, or where the order cannot be processed. In such cases, you will be notified within two working days.
d. PRINT3D PRECISION may revoke or cancel any quotation or order at any time during the quotation, ordering, or production process if technical reasons prevent fulfilment. In such cases, all monies paid will be refunded.
e. PRINT3D PRECISION reserves the right to reject orders that conflict with its mission and values. This includes, but is not limited to, firearms, weapon components, or designs raising ethical concerns. PRINT3D PRECISION may discontinue execution of such orders at any stage.
f. You acknowledge that PRINT3D PRECISION does not act as a medical professional. Products must not be used for diagnosis, treatment of disease, or in surgical applications.
g. Prices charged at order placement are based on achievable production levels of detail. In some cases, requested material/finish/colour/quantity combinations may not be technically possible. PRINT3D PRECISION will make best efforts to contact you but reserves the right to adjust the order (including thickness, production method, price, and delivery terms) as necessary.
PRINT3D PRECISION will not share your uploaded design file with third parties unless required for production purposes. Any such third parties are bound by confidentiality obligations equivalent to those of PRINT3D PRECISION.
h. PRINT3D PRECISION maintains records of all orders and provides you access to them indefinitely. We recommend you keep a printed copy of these Terms as well as your order confirmation and invoice.
4. Price – Payment
a. Prices calculated by PRINT3D PRECISION include service fees, production costs, and shipping charges, as well as applicable taxes. Insurance is not included. Any additional duties or taxes for delivery, even if not listed on the invoice, remain your responsibility.
b. All prices are quoted in AUD. Offsetting against non-approved counterclaims or exercising retention rights is excluded unless established in court, undisputed, or expressly recognised by PRINT3D PRECISION. PRINT3D PRECISION retains full ownership of all products until complete payment has been received, including transport costs and taxes.
c. Separate components of a quotation may be invoiced individually. PRINT3D PRECISION reserves the right to suspend production or delivery of outstanding items or subsequent orders while invoices remain unpaid. PRINT3D PRECISION remains the legal owner of all products until full payment has been received. In exceptional cases and at its sole discretion, PRINT3D PRECISION may extend payment terms, which will be set at 30 days from the end of the month of invoicing.
5. Term of Delivery – Risk of Transport
a. The average production time for a model is approximately three (3) working days. This is an indicative timeframe only and is not binding on PRINT3D PRECISION. Actual delivery times may vary depending on working conditions, material availability, and other factors at the time the contract is agreed.
b. If payment details are incorrect, delivery will be delayed until correct information is provided.
c. PRINT3D PRECISION selects reputable carriers and delivery methods at its discretion. Risk of loss or damage during transport passes to you once goods are dispatched.
6. Inspection – Returns – Replacements – Refunds
a. As products are made to your specifications, they cannot be returned or cancelled once production has begun.
b. You must carefully inspect products immediately upon delivery. If you believe a product does not conform to your order, you must notify PRINT3D PRECISION as soon as possible and no later than 14 days after receipt. Failure to do so, or use of a non-conforming product, releases PRINT3D PRECISION from liability for any consequences.
c. Products must not be returned without an explicit request from PRINT3D PRECISION.
d. PRINT3D PRECISION reserves the right to revoke or amend quotations or order confirmations for technical reasons. Liability for proven damages is limited to the purchase price of the affected product. PRINT3D PRECISION accepts no liability for consequential, indirect, or third-party damages.
e. Internet communications are subject to risks such as tampering, corruption, and delays. PRINT3D PRECISION does not accept responsibility for errors or issues arising from email communication. Sensitive information sent by email is at your own risk unless you have notified PRINT3D PRECISION in writing that email is not an acceptable form of communication.
7. Intellectual Property
a. PRINT3D PRECISION grants you a limited, non-exclusive licence to generate quotations and place orders through its platform. PRINT3D PRECISION retains all intellectual property rights to its website, systems, and services. Reverse engineering, disassembly, or decompilation is prohibited.
b. The print3dprecision.com.au website contains trademarks and brand names belonging to PRINT3D PRECISION. These, along with all copyrighted content, may not be copied or reproduced for commercial purposes without prior written consent from PRINT3D PRECISION or the respective rights holder.
c. PRINT3D PRECISION provides an online service allowing users to design and order products. Users are strictly prohibited from using the service to create or sell products that infringe third-party intellectual property rights. You are solely responsible for the content you upload. By submitting a design, you confirm that you own the rights or have secured permissions for its use. PRINT3D PRECISION will not claim ownership of your designs. However, if a design is suspected of infringing third-party rights, PRINT3D PRECISION may refuse to produce it or alter it to avoid infringement. You agree to defend and indemnify PRINT3D PRECISION against any claims, damages, or costs related to intellectual property disputes.
d. You acknowledge that electronic systems are vulnerable to errors, tampering, or malicious code. While PRINT3D PRECISION takes reasonable precautions, it cannot guarantee such risks will not occur. You are solely responsible for ensuring files downloaded from the site are free from viruses or harmful code. You agree to indemnify PRINT3D PRECISION from any damages or claims arising from such risks.
8. Confidentiality
a. PRINT3D PRECISION will treat your 3D design files as strictly confidential. Files will only be shared with third parties when required for production, and such third parties will be bound to the same confidentiality standards.
b. By submitting an entry (including 3D files, images, or descriptions) for a contest or challenge, you grant PRINT3D PRECISION a non-exclusive, royalty-free, worldwide licence to display and reproduce your design for marketing purposes. This includes photography, 3D reproductions, and publication across print and digital media. PRINT3D PRECISION will never sell your design. By submitting, you confirm you are the rightful creator or have obtained all necessary permissions.
9. Limitation of Liability
a. Access to PRINT3D PRECISION’s website or services does not create any professional or fiduciary relationship between you and PRINT3D PRECISION.
b. All information and services are provided “as is” without warranties of any kind. PRINT3D PRECISION disclaims implied warranties of merchantability, fitness for purpose, and non-infringement. Service may be interrupted or contain errors.
c. PRINT3D PRECISION is not liable for direct, indirect, incidental, or consequential damages, including but not limited to lost profits, injury, death, data loss, or business interruption. Liability is strictly limited to the purchase price of the product concerned. You bear full responsibility for the intended use of your designs and printed parts.
d. PRINT3D PRECISION, its employees, and affiliates are not liable for personal injury, including death, resulting from use of our services.
e. By using our services, you acknowledge the inherent risks of 3D printing and assume full responsibility for safe use of products.
f. You are responsible for ensuring your designs comply with relevant safety standards and regulations. PRINT3D PRECISION does not verify suitability or safety for specific applications.
10. Data Protection and Privacy
a. By submitting an order, you consent to PRINT3D PRECISION processing your personal data (such as name, address, contact details, etc.) as necessary to fulfill your order and meet legal obligations.
b. In some cases, PRINT3D PRECISION may request additional information (e.g., ID verification or credit card copies) for fraud prevention or security purposes. This will also be treated as personal data.
c. Personal data is collected for the following purposes:
1) fulfilling contractual obligations,
2) gathering feedback on services,
3) providing updates on products and services,
4) improving service quality.
d. PRINT3D PRECISION may share personal data internally across its business operations in Australia.
e. Personal data will not be disclosed to external parties without your consent, except where required by law or where third-party providers support production or delivery. In such cases, PRINT3D PRECISION ensures they follow strict privacy and security standards.
